Big relief to Imran Khan in Toshakha case, Islamabad High Court stays sentence, orders release

Former Prime Minister of Pakistan and leader of Pakistan Tehreek-e-Insaf Imran Khan, imprisoned in the Toshakha case, has got a big relief. The Islamabad High Court has stayed the sentence of former Prime Minister of Pakistan Imran Khan in the Toshakha case. Along with this, Pakistan's Islamabad High Court ruled in favor of Imran Khan and ordered his release. Imran Khan was accused of buying government gifts at cheap prices and then selling the same gifts at high prices.

Earlier, the High Court had reserved the verdict

The Islamabad High Court on Monday reserved its verdict on a plea seeking suspension of Imran Khan's three-year jail sentence in the Toshakha corruption case. A division bench of the IHC comprising Chief Justice Aamir Farooq and Justice Tariq Mahmood Jahangiri reserved the verdict after hearing counsel for both the parties. A lower court on August 5 convicted Pakistan Tehreek-e-Insaf chief Khan and sentenced him to three years in prison in the case. Imran Khan was accused of illegally selling government gifts received by him and his family during his tenure from 2018-2022. The Sessions Court convicted him in this case. He has been banned from politics for five years. Due to this, he will not be able to participate in the next general elections.

What are branch cases?

According to Pakistani law, any gift received from a foreign dignitary has to be kept in the State Depository i.e. Toshakhana. If the head of state wants to retain the gift, he has to pay an amount equal to its value. This is determined by the auction process. These gifts are either deposited in the Toshakhana or can be auctioned and the proceeds are deposited in the national treasury.

Pakistan Tehreek-e-Insaf (PTI) party chief Imran Khan has been accused of buying gifts including an expensive graph wristwatch at a discount from the state depository, Toshakhana, and selling them for profit when he was prime minister. Imran Khan received 58 gifts worth around Rs 14 crore during his official visits. This expensive gift was deposited in Toshakhana. Later Imran Khan bought them from Toshakhana at a cheap price and later sold them in the market at a high price. He also changed the government law for this whole process.

According to media reports, Imran bought these gifts from Toshakhana for Rs 2.15 crore and sold them for a profit of Rs 5.8 crore. The gifts included a Graff watch, a pair of cufflinks, an expensive pen, a ring and four Rolex watches. He was disqualified by the Election Commission of Pakistan in October last year for not sharing sales details.
